Amendment IX of the Constitution: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”

Does one consenting adult have the right to marry another consenting adult?

If your answer is yes, then banning gay marriage is a violation of the Constitution for denying its citizens a fundamental right.

If your answer is no, please explain why chosing to marry who you like is not a fundamental right.

If your answer is “It’s a crime against God,” please refer to the First Amendment which prevents the Government from making laws based on religious dogma.

(In other words, if your Senator was a Muslim, would you want him passing laws forbidding you from being married because you’re Christian? Or do you think that would violate your Constitutional right to worship as you see fit?)
